Way To Nomads – Travel Booking Terms & Conditions

By booking a trip with Way To Nomads, you agree to the following terms and conditions. Please read them carefully before making a booking.

1.The Parties Involved:

  • Way To Nomads: The organizer and vendor of the holidays, registered in Mongolia (Company Number: 4418891).

  • You (The Buyer): The person booking a service, such as an all-inclusive holiday or tailored tour, with Way To Nomads.


2. How to Book:

  1. To make a booking, complete our booking form online or request one via email. The first-named person (party leader) must sign the form and confirm their authority to make the booking for all travelers in the group, including minors.

  2. Once we receive your completed form and deposit (see Payment Terms below), we’ll issue a confirmation invoice. Please review it and notify us of any errors within 5 working days.

  3. We’ll communicate mainly by email, so please check your inbox regularly. We may also contact you by phone if needed.


3. Payment Terms:

  • Deposit: A deposit of 30% of the total tour cost is required to secure your booking. For special tours (e.g., Naadam, Golden Eagle Festival, Lunar New Year), the deposit may be higher, up to 50%.

  • Final Payment: The full balance is due no later than 6 weeks before your trip. If payments are not received on time, we may cancel your booking and keep any payments made up to that point.

  • Late Bookings: If booking less than 6 weeks before departure, full payment is required immediately.

  • Payment Methods:

    • Credit Card: We accept Visa/MasterCard for online payments. A 4% surcharge applies to credit card payments for the balance.

    • Bank Transfer: Bank transfers are also accepted. Please note that international fees are covered by you, and it may take 2-3 working days for the payment to reach us.

Additional Notes:

  • Certain tours may have different payment and cancellation terms, so please refer to your specific itinerary for details.

  • It’s important to ensure all details on your booking are accurate as changes after the confirmation may incur extra costs.


4.CANCELLATION AND REFUND

4.1 Cancellation by You:
If you or any member of your group needs to cancel your booking, the party leader must notify us in writing. Cancellation is effective only when we receive your written notice.

4.2 Cancellation Fees:
As we incur costs upon confirming your booking, the following cancellation charges apply based on when we receive your written notice:

  • Deposit: Non-refundable

  • 61+ days before departure: 30% of tour cost

  • 60–31 days before departure: 50% of tour cost

  • 30–21 days before departure: 75% of tour cost

  • Less than 20 days before departure: 100% of tour cost

4.3 Insurance Claims:
You may be able to reclaim cancellation charges (less excess) through your travel insurance. Claims should be made directly with your insurance provider.

4.4 Private Bookings:
If a cancellation reduces the number of full-paying members below the original number, we will recalculate costs and re-invoice accordingly.

4.5 Special Tours:
Certain tours (e.g., Naadam Festival, Golden Eagle Festival, Lunar New Year) require payment up to 120 days before departure. These may result in a 100% loss upon cancellation. Details will be on your invoice.


5.CHANGES BY YOU

5.1 Requesting Changes:
If you need to change your booking, the lead name must notify us in writing. We will try our best to accommodate the change, but cannot guarantee it.

5.2 Costs of Changes:
You will be responsible for any costs incurred by us or our suppliers to process the change. These costs may increase as the departure date approaches, so notify us as soon as possible.

5.3 If Changes Aren’t Possible:
If we cannot accommodate your change and you choose not to proceed with the original booking, it will be treated as a cancellation, subject to cancellation fees.

5.4 Transferring a Place:
If a member of your party cannot travel, their place may be transferred to someone else if notified at least two weeks before departure. An amendment fee of 80 USD (or equivalent) plus any costs incurred by us or suppliers will apply. For flight-inclusive bookings, airline charges for name changes will also apply.


6.CHANGES AND CANCELLATIONS BY US

6.1 Right to Change or Cancel:
We may need to make changes to or cancel a booking. While we strive to avoid changes, we reserve the right to do so under any circumstances.

6.2 Minor Changes:
Minor changes (e.g., a slight departure time change or different accommodation of the same standard) will be communicated as soon as possible.

6.3 Significant Changes:
Significant changes (e.g., a lower standard of accommodation, major itinerary changes, or a departure delay of 12+ hours) will be communicated to you. In such cases, you may choose to:

  • Accept the change,

  • Book an alternative tour (of equivalent or higher standard), or

  • Cancel for a full refund, excluding amendment charges.

6.4 Compensation for Significant Changes:
Compensation may be provided depending on the circumstances, except in cases of force majeure (see clause 14) or if you failed to comply with the booking conditions.

6.5 Force Majeure:
In the unlikely event of force majeure (e.g., natural disasters, strikes, terrorism), we may change or cancel your tour. No compensation will be payable, and we cannot be held responsible for any related costs.

6.6 Health or Behavior Issues:
If your physical condition or behavior affects the well-being of others or the tour, we may cancel your participation without a refund.

6.7 Single Room Availability:
If we cannot provide a single room as requested, we may room you with another traveler of the same sex and provide a refund on a pro-rata basis.


7.SPECIAL REQUESTS

Please inform us of any special requests (e.g., dietary needs, accessibility requirements) at the time of booking. While we will try to accommodate these, we cannot guarantee fulfillment of all requests. If we are unable to meet your needs, we may ask you to travel with someone who can assist.


8.SURCHARGES

The price of your tour may change due to variations in transportation costs, government taxes, or currency exchange rates. If the price increases by more than 10%, you may cancel and receive a full refund (except for amendment charges). You must notify us within 14 days of the invoice date if you wish to cancel due to this.


9.TRAVEL DOCUMENTS AND CONDUCT

9.1 Travel Documents:
Check your travel documents carefully. Ensure your passport has at least six months validity and that visas are in order. Notify us immediately if any details are incorrect.

9.2 Behavior:
You must follow our instructions and behave respectfully toward others on the tour. You are responsible for any damage you cause.

9.3 Loss and Injury:
We are not responsible for loss, injury, or damage resulting from your failure to comply with local laws.

9.4 Indemnity:
You agree to indemnify us against any third-party claims related to your actions during the tour.


10.INSURANCE AND MEDICATIONS

10.1 Travel Insurance:
We highly recommend purchasing travel insurance that covers personal injury, medical expenses, loss of baggage, and trip cancellation.

10.2 Health Issues:
Inform us of any health issues, medications, or insurance details by email before your trip.


11.COMPLAINTS

11.1 On-Tour Complaints:
If you have a complaint during your tour, inform the tour leader or guide immediately. They will document the issue and attempt to resolve it.

11.2 Post-Tour Complaints:
If unresolved after your tour, submit your complaint in writing to us within 2 weeks, along with supporting evidence.


12.PERSONAL DATA PROTECTION

We will keep your personal data secure. You consent to the use of your name and email for marketing purposes unless you opt out by emailing us. We do not sell personal data to third parties. We may take photos during tours for promotional use, unless you request otherwise.


13.LIABILITY AND RESPONSIBILITY

13.1 Inherent Risks:
You understand and accept the inherent risks of participating in tours and agree to take responsibility for your own safety.

13.2 Incorrect Information:
We are not liable for any incorrect information on the website. The tour details confirmed with us are the final version.

13.3 Liability Exclusion:
We are not responsible for any loss, injury, or damage caused by factors beyond our control, including weather, strikes, and acts of government.

13.4 Special Activities:
Activities like horseback riding or hiking are undertaken at your own risk. We will provide guidance, but we are not responsible for any accidents that occur during these activities.

13.5 Behavior and Safety:
You must follow the instructions of your tour guide for your safety and the well-being of the group. Failure to comply may result in being asked to leave the tour without a refund.


14.FORCE MAJEURE

We are not liable for any changes, cancellations, or costs resulting from force majeure events, including war, riots, epidemics, natural disasters, or strikes.


15.LEGAL TERMS

These terms are governed by Mongolian law, and any disputes will be resolved in a Mongolian court. Any claims must be made within 2 weeks of your tour’s completion.
